However, one of the crucial issues in using these contracts in the Iran's economy is the compliance of their provisions with the rules of Imami jurisprudence (Fiqh). The main question of the research is what are the most noteworthy jurisprudential doubts related to the discussion of the cost of money in the upstream oil and gas contracts (including reciprocal sale and IPC) and the Sharia solutions to resolve these doubts. The research findings, achieved by descriptive and content analysis method showed considering that the legal nature of these contracts is not borrowed, the cost of money in these contracts can not necessarily be considered usury. Because in these contracts, there is collaboration between the employer and the contractor to carry out real activities in the field of oil and gas, this interaction can be analyzed in the form of a new contract or a peace contract. The surplus related to the delay in payment of the debt can be accepted according to the opinion of many jurists and the Guardian Council, if it is mentioned as a condition in the contract. However, this challenge can be solved by using the jurisprudential solution of "mitigation";}, keywords = {Cost of money,upstream contracts,oil and gas,Islamic jurisprudence,Iran}, title_fa = {تحلیل فقهی ماهیت هزینه‏های پول در قراردادهای بالادستی نفت و گاز ایران}, abstract_fa = {صنعت نفت در کشورهای دارای ذخایر، نیاز به جذب سرمایه‏گذاری بالا و استفاده از فناوری‎های نوین و پیشرفته دارد که این مسئله معمولاً با قراردادهای بالادستی تأمین می‏شود. باوجوداین، یکی از مسائل مهم در استفاده از این قراردادها در اقتصاد کشور، انطباق مفاد آنها با ضوابط فقه امامیه است. پرسش اصلی تحقیق آن است که شبهات مهم فقهی در بحث هزینه پول در قراردادهای بالادستی نفت و گاز (شامل بیع متقابل و IPC) و راهکارهای شرعی حل این شبهات کدام است؟ یافته‎های تحقیق که به روش توصیفی و تحلیل محتوا به ‎دست ‎آمده نشان می‎دهد قراردادهای بالادستی حوزه نفت و گاز را می‎توان در راستای فعالیتی حقیقی و مفید برای کشور یعنی توسعه بخش نفت و گاز در نظر گرفت که یکی از زیرساخت‎های توسعه اقتصادی کشور محسوب می‎شود. براساس‌این، می‎توان کلیت قراردادهای بالادستی نفت و گاز را در ذیل اصل فقهی و حقوقی «صحت و لزوم» قراردادها پذیرفت؛ البته لازم است وجود شبهاتی مانند ربا یا غرر در رابطه با مفاد آنها بررسی شود. در این رابطه مسئله «هزینه پول» در این قراردادها می‎تواند با شبهه ربای قرضی مواجه باشد و لازم است راهکارهای شرعی جایگزین در این زمینه استفاده شود. مازاد مرتبط با تأخیر تأدیه دین نیز اگر به‌صورت شرط ضمن عقد در قرارداد ذکر شود، براساس نظر بسیاری از فقها و شورای نگهبان، قابلیت پذیرش دارد. سرانجام، با توجه به اینکه نرخ هزینه پول در قراردادهای بالادستی معمولاً به‌صورت شناور (لایبور به‌علاوه عددی ثابت) تعیین می‎شود، شبهه غرر در رابطه با این قراردادها مطرح می‎شود. باوجوداین، می‎توان با استفاده از راهکار فقهی «تخفیف» این چالش را برطرف نمود؛ یعنی کارفرما و پیمانکار از ابتدا در رابطه با حداکثر نرخ احتمالی هزینه پول توافق می‎کنند و پیمانکار در قالب شرط ضمن عقد می‎پذیرد که در عمل براساس فرمول «لایبور به‌علاوه عدد ثابت» به کارفرما تخفیف دهد. در این شرایط به دلیل آنکه نرخ هزینه پول از ابتدا برای طرفین مشخص است، لذا شبهه غرر از این معاملات برطرف می‎شود.}, keywords_fa = {هزینه پول,قراردادهای بالادستی,نفت و گاز,فقه اسلامی,ایران}, url = {https://iee.rihu.ac.ir/article_1936.html}, eprint = {https://iee.rihu.ac.ir/article_1936_a594eb1f2209c0b1c97da09d7f3441d2.pdf} }
